Thank you for choosing Yellow Digital for your marketing and graphic design needs. These Terms and Conditions govern the use of our services, and by engaging with us, you agree to abide by the terms outlined below.

Scope of Services:

Yellow Digital agrees to provide marketing and graphic design services as agreed upon in the project proposal or agreement.

Payment Terms:

Clients are required to adhere to the payment terms outlined in the project proposal or agreement. Late payments may incur additional fees or suspension of services. In most cases, this is 50% upfront, 50% upon delivery.

Intellectual Property:

All intellectual property rights associated with the deliverables, including but not limited to logos, graphics, and marketing materials, will be transferred to the client upon full payment.

Portfolio and Marketing:

Yellow Digital reserves the right to include any final work produced for the client in our portfolio and marketing materials, both online and offline, unless otherwise agreed upon in writing.

All final materials are owned by your business/organisation.

Confidentiality:

Yellow Digital agrees to keep all client information confidential and will not disclose any proprietary or confidential information to third parties without the client's written consent.

Client Responsibilities:

The client agrees to provide timely and accurate information necessary for the completion of the project.

Client feedback and approvals are crucial for project progression, and delays may occur if timely responses are not provided.

Revisions and Changes:

The client is entitled to a certain number of revisions, as specified in the project proposal or agreement.

Additional revisions or major changes beyond the agreed scope may be subject to additional charges.

Termination of Services:

Either party may terminate the services with written notice if the other party breaches any material term of this agreement.

Upon termination, the client agrees to pay for all services provided up to the termination date.

Limitation of Liability:

Yellow Digital shall not be liable for any indirect, consequential, or incidental damages arising out of the use or inability to use the services.

Governing Law:

These Terms and Conditions shall be governed by and construed in accordance with the laws of Western Australia.

Changes to Terms and Conditions:

Yellow Digital reserves the right to update these Terms and Conditions at any time. Clients will be notified of any material changes.
